I have spoken to a person at Medicare and also have asked the question of my HR agent and still do not have answers. First I will give some underlying information which is important to know. I run a small German subsidiary and have for the past 6 years. We employ a total of 13 people country wide. Because we are small we use a PEO (Professional Employer Organization) for all of our payroll, benefits and HR needs. This gives us large group health insurance coverage. I am turning 65 in October so I have received notices that I need to sign up for Medicare. In addition my wife turned 70 this year. I was ignorant about having to sign her up for Medicare when she turned 65. So that is another complication. In addition my wife has been a stay at home mom and has not worked enough to qualify for the Social Security Insurance. I understand that when I do retire that she would then be eligible to receive half of my insurance monthly benefit.
I wanted to talk with someone at the SSA and they told me that I had to make an appointment for a call which I did. The appointment for the call was 2 months out. As I spoke to the person on the phone she told me that if I had Group Benefits plan under my employer that I could have a waiver for the part B. I told her that our company was under a PEO which provides a Group Benfits Plan and described that to her and she said that that does not qualify for a Group Benefits Plan. I asked her why that would not qualify and she said she would speak with someone else and come back to me. When she came back she said that that would not qualify. But then she said that I could fill out forms L564 and 40B and put in writing why I thought that this would qualify for a Group Benefits Plan. She also told me that I would need to fill out an SSA 3 form proving that my wife was married to me.
In addition I spoke to my HR person at the PEO and she told me that we were covered under a Group Benefits Plan with the PEO but that she could not assist me in any way regarding Medicare and gave me a number to another company to call which I did and again they were not very helpful either.
I did read this post https://mymedicareforum.com/threads...-working-and-having-employer-insurance.10294/ and found it to have some helpful information. It looks like my PEO should fill out form L564. I am not sure about form 40B. I also saw on this thread specific information about Part D which no one has mentioned yet but again I need to have proof of that from the PEO as well. Both my wife and I have had full medical coverage from a PEO while working at my present job. However we have changed PEO's twice thus far and may change again due the increasing medical premium costs. So does that mean I need to go back to prior PEO's and have them fill out the L564 and 40B for both my wife and myself to prove that we were covered by a Group Benefits Plan?
I am sorry for the long and detailed post and I am also thankful if anyone has any experience on this that could give some insite to it all.
