The Broken Medicare Secondary Payer System

When a Medicare beneficiary is injured and another party is supposed to cover their healthcare expenses – such as in a workers’ compensation claim – Medicare’s legal responsibility to pay is “secondary.”

If a Medicare beneficiary is injured and another entity is required to pay for their healthcare expenses – such as in a tort case, workers compensation claim, or auto insurance payment – there can often be significant disruptions in the future of that person's medical care. Under the current secondary payer system, you can be denied coverage by Medicare after being reimbursed from an automobile or workplace injury.

Have you experienced difficulty with the Medicare Secondary Payer system? How has it impacted your access to care?
